3.2 Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may temporarily suspend Services for maintenance, updates, or security reasons with reasonable notice when possible.

4. Acceptable Use

4.1 Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. You agree to use the Services to:

You retain ownership of Customer Data you submit. You grant us a license to use Customer Data solely to provide and improve our Services.

Our processing of personal data is governed by our Privacy Policy and, where applicable, our Data Processing Agreement (DPA).

7.2 Your Responsibilities

You are responsible for:

• Maintaining appropriate security measures for your systems

8. Confidentiality

Both parties agree to keep confidential any non-public information disclosed during the use of Services. This obligation does not apply to information that:

• Is publicly available without breach of this agreement
• Was known to the receiving party before disclosure
• Is independently developed without use of confidential information
• Is required to be disclosed by law

9. Warranties and Disclaimers

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• KURABIYE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM
• THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY

11. Indemnification

You agree to indemnify and hold harmless Kurabiye and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your Customer Data or End User interactions

12. Term and Termination

12.1 Term

These Terms are effective until terminated by either party.

12.2 Termination by You

You may terminate your account at any time through your account settings or by contacting support. Termination takes effect at the end of your current billing period.

12.3 Termination by Us

We may suspend or terminate your access if:

• You breach these Terms
• Your payment fails after reasonable notice
• Your use poses a security risk
• Required by law or regulation

12.4 Effect of Termination

Upon termination:

• Your right to access the Services ends
• You may export your data within 30 days
• We will delete your data per our retention policy
• Provisions that should survive termination will remain in effect
